The Wizengamot was wizarding Britain’s high court of law and parliament. It predated the British Ministry of Magic itself, dating back to the days of the medieval Wizards’ Council. Its administrative headquarters were located in the Department of Magical Law Enforcement of the Ministry of Magic, whilst the trials took place in the dungeons of the lower levels. [2]

While courts were in session, members wore plum-coloured robes embroidered with a silver letter W. [2]

Function

The modern Wizengamot functioned as a combination of court and parliament, serving both as the main legislative body of the Ministry of Magic, as well as its highest tribunal. [3] It was made up of around fifty members. The process for selecting members was unclear, though the Minister for Magic appeared to have some power over the final selection. Aside from the judges and the Chief Warlock, there was a Court Scribe that recorded the proceedings while the Wizengamot was in session.

The Minister for Magic, Senior Undersecretary to the Minister, and Head of the Department of Magical Law Enforcement were known to attend significant trials and hearings, but it is unknown if this was routine. A British Youth Representative, who had to be no more than 17 years old, could be present at times as well. [4] An incorrect answer on the W.O.M.B.A.T. test was that the average age of a Wizengamot member was 87 years old, this was presumably not true. [5]

During the 1989–1990 school year, veteran Auror Alastor Moody explained to Jacob’s sibling that while the full Wizengamot would occasionally convene to oversee court proceedings, a vast majority of Dark Wizards were tried by the Council of Magical Law. [6]

Given that the Wizengamot was presided over by the Minister for Magic in the 1995 trial of Harry Potter, the period in which Albus Dumbledore had lost this title of Chief Warlock of the Wizengamot, it is unclear whether the Minister always headed the Wizengamot, or if he took on the role of Chief Warlock himself. It is also possible that the Chief Warlock acted as an impartial executive figure, much like the Queen does over the British and Commonwealth Parliaments.

History

The Wizengamot predated the British Ministry of Magic. It was in activity since, at least, 1544. [7]

In 1707, when the Ministry of Magic was established, the Wizengamot was incorporated into the newly-created Department of Magical Law Enforcement. The first Minister for Magic, Ulick Gamp, had previously been Chief Warlock of the Wizengamot. [1]

Dolores Umbridge lied to other people that her deceased father was a distinguished member of the Wizengamot. This was to cover her father’s career as an unambitious janitorial worker in the Magical Maintenance Department. As nasty things tended to happen to anyone who asked Dolores about things she did not like to speak of, her father being one of them, those who wished to remain on her good side would pretend to believe her fake version of her ancestry. Albus Dumbledore as the Chief Warlock of the Wizengamot

Albus Dumbledore held the position of Chief Warlock of the Wizengamot in the 20th century, except during the period of July 1995 to June 1996, in which he was removed from the post because of his insistence that Lord Voldemort had returned. In the same period, two of the Wizengamot’s oldest members, Griselda Marchbanks and Tiberius Ogden, resigned from the court in protest after Cornelius Fudge created the position of Hogwarts High Inquisitor to usurp control of Hogwarts from Dumbledore, and were subsequently discredited alongside him; it is unknown if they were reinstated afterwards. Harry Potter’s Wizengamot trial for underage magic

On 12 August 1995, [13] the Wizengamot tried Harry on a charge of violating the Decree for the Reasonable Restriction of Underage Sorcery. Harry had been forced to produce a Patronus to defend himself and his cousin Dudley Dursley against two Dementors.

The time of the hearing was changed sometime the night before the trial, and although the Wizengamot sent a letter to Harry informing him of this, it was sent so close to the time of the trial that it was intended that he not receive it in time. Nonetheless, Albus Dumbledore presented Harry’s defence, and Cornelius Fudge reluctantly dismissed the charges after a majority voted in favour of clearing him. [2] It was later revealed that Dolores Umbridge had sent the Dementors to attack Harry in order to silence him. [14]

Percy Weasley later sent a letter to his brother Ron referring to «the whole Wizengamot,» implying that this type of trial was unusual. Smaller disciplinary hearings do not require the court’s attention at all and are dealt with by a single investigator, as the original hearing was supposed to be in Amelia Bones’s office, and that Dumbledore himself noted the unnatural change to press forward with a full trial on a simple case of underage magic due to Fudge’s haste in law changing.

The Wizengamot, originally known in medieval times as the Wizards Council, is an ancient legal council of witches and wizards which nowadays functions as a combination of court and parliament. The Council is tasked with the interrogation of convicted magical criminals, to decipher their wrong doings, if any, and decide whether or not said criminal is innocent or guilty. They are also involved in the debating and creation of various laws throughout the British isles. The Wizengamot Headquarters are on Level 2 of the Ministry of Magic within the Department of Magical Law Enforcement. The Courtroom used by the Council is located on Level 10 beneath the Department of Mysteries.

Typically, the court has up to 50 members, who each hold seats in the chamber for various reasons. Unlike the elected Minister for Magic, Wizengamot members are mostly appointed by a process involving the Minister and Wizengamot leadership. A number of judicial members, known as Seated Members, are appointed directly to the Wizengamot to serve as justices of the court. Ministerial Heads of Department and other senior figures also sit in the Council ex officio. It is also common for holders of the Order of Merlin to hold seats as well as various other witch and wizards the Minister for Magic trusts.

A Chief Warlock, who is usually expected to be impartial, presides over each case, and depending on the level of severity, may be accompanied by a Magistrate, the Head of Magical Law Enforcement, the Senior Undersecretary to the Ministry of Magic, a British Youth Representative and a Court Scribe.

Functions and Procedure

Judicial Function

The Wizengamot serves as the Wizard High Court of Law with the responsibility for conducting trials of those accused of the most serious offences against Magical Law. The Wizengamot operates under an inquisitorial system where the members of the court assess the facts, question the accused and any witnesses, and reach the final verdict. Convention adopts three different trial procedures depending upon the severity of the offence:

Wizengamot trials have historically been brief and concise but the modern-day Council has made efforts to make these trials more open and structured. The accused may present witnesses to be questioned by the Wizengamot. A third-party with legal knowledge may speak on behalf of a defendant, fulfilling a similar role to that of a modern advocate, yet this practice is still rare. The accused is magically secured to a chair in the middle of the Courtroom. The presiding judge will ask for the presentation of the case against the accused before they are interrogated by members of the court. Upon the final verdict, the penalty will be assigned by the Chief Warlock or else the presiding judge under the chosen procedure.

The Wizengamot also has the ability to conduct a Hearing to investigate matters before a trial is considered, particularly for Ministry internal matters. Hearings are normally conducted by a select committee from the court. The Wizengamot also adopts a distinct form of trial for underage Wizards known as a Disciplinary Hearing which can be conducted under any trial format as required. Such trials are normally closed to public view with the exception of representatives of the press who are permitted upon the understanding that the names of underage parties must not appear in any final release. Underage wizards are entitled to request that the British Youth Representative be present.

Legislative Function

The Wizengamot also serves as a deliberative assembly for the British Wizarding community. Legislative authority in the Ministry of Magic is ultimately vested in the Minister for Magic. The Wizengamot’s purpose is to use its legal and professional experience to scrutinize, revise, and advise upon proposed legislation as required. Legislative sessions are overseen by the Chief Warlock or Magistrate acting in his place.

Ceremonial Function

The Wizengamot is a distinguished institution within public life for the British wizarding community. Members of the Council are expected to behave with honour, dignity, and discretion in public affairs. The Wizengamot is responsible for bestowing the Order of Merlin upon witches and wizards who have achieved great distinction within the wizarding world.

The Chief Warlock partially serves as an impartial civic figure in comparison to the expressly political authority of the Minister for Magic. The incumbent Chief Warlock is Alistair Colquhoun who was appointed to the office from his previous role as Magistrate. He is known for his stern demeanor and sharp legal mind.

Magistrate / Vice-Chancellor

The Magistrate (formerly known as the Vice-Chancellor) provides legal counsel and guidance to members of the court. The original title of Vice-Chancellor was first given to Zimelda Zemeckis by Chief Warlock Judy Dorchester. In recent years, the title fell into discredit due to the fall of Dorchester’s reputation. In order to improve its image, the title was changed to Magistrate with the appointment of Alistair Colquhoun. During his tenure, Colquhoun successfully transformed the office into a respectable legal position. The holder now essentially serves as the Legal Advisor and Chief Interrogator, although the case for the prosecution will typically be presented by the Department of Magical Law Enforcement. In many cases the Magistrate may also preside over trials in place of the Chief Warlock. The incumbent Magistrate is Anemone Case who was appointed in March 2027.

Wizengamot Members

The Seated Members (or Council) participate in hearings and trials by questioning those who stand accused, participating in various debates, and voting on important matters such the convictions of the accused, or new laws. Certain Ministry officials hold their seats ex officio in virtue of their positions of responsibility in the Ministry but members can also be appointed individually to the Wizengamot for its own purposes as Seated Members. The Wizengamot membership typically includes:

Members of the Wizengamot are currently appointed upon the advice and scrutiny of a Wizengamot Appointments Committee consisting of the Chief Warlock, Magistrate, and select Seated Members. The Minister for Magic will sometimes appoint or remove members under her own powers.

Court Scribe

The Court Scribe’s duty is to put the hearing or trial into word form, through use of quill and scroll. A scribe will attend all court business. They are, however, an employee of the Wizengamot Administration Services rather than a member of the court, so they have no right to participate in its proceedings.

British Youth Representative

The British Youth Representative is a coveted spot held by an exceptional student, usually from Hogwarts School of Witchcraft and Wizardry. They attend the hearings and trials of young witch and wizards so that they can be fairly represented, and can be granted leave from the castle in these rare cases.
